RE:Fashion Awards
Terms and Conditions
General
1. The RE:Fashion Awards (the "Awards") are administered by RE:Fashion, a collaboration between Anti-Apathy, The Ethical Fashion Forum and Futerra.
2. RE:Fashion reserves the right to cancel the Awards at any stage, or change any of the rules or procedures if deemed necessary in its opinion, or if circumstances arise outside its control.
3. By entering the Awards, entrants (the "Entrants") will be deemed to have accepted these rules and to agree to be bound by them.
4. These rules are governed by the laws of England and Wales and RE:Fashion and Entrants submit to the exclusive jurisdiction of the courts of England and Wales.
Entrants
5. Application to the Awards is open to UK and non-UK residents aged at least 18 years of age on the date they submit their application.
6. More than one application per category of the Awards is allowed per designer, company or organisation. Only one application per Award is allowed.
7. This competition is not open to employees or contractors of RE:Fashion, Anti-apathy, The Ethical Fashion Forum and Futerra, any person directly or indirectly involved in RE:Fashion or the Awards, including the Award sponsors, or the direct family members of any of the afore mentioned.
Applications
8. To enter the Awards, Entrants must complete the online application form available on Awards' website (www.refashionawards.org/awards) and submit it with any additional material requested in the application form to the address given on the application form. Any additional material requested will be returned by September 2009.
9. Entries must be received by RE:Fashion by midnight on 20th August 2008.
10. Incomplete applications will not be accepted.
11. RE:Fashion does not accept any responsibility for late or lost entries due to the internet or postal service. Proof of sending is not proof of receipt.
12. Award Entrants must pay GBP 25.00 in order to have their application processed. Entrants that earn under GBP 20, 000 or businesses that turn over less than GBP 20, 000 are exempt from this fee.
Entries
13. All design work and supporting materials must be entirely the Entrant's own original work and not breach any intellectual property rights of a third party. The Entrant warrants that the entry and the use of it by RE:Fashion for the purposes contemplated by the Awards shall not breach any such rights.Judging
14. The panel of judges (the "Panel") will be appointed by and at the discretion of RE:Fashion.
15. The Panel will determine the shortlist and ultimate winners of the Awards.
16. All of the Panel's decisions are independent of the administration of the Awards.
17. The Panel's decision is final and no correspondence or discussion will be entered into.
18. RE:Fashion reserve the right to change the Panel at any stage if deemed necessary in its opinion, or if circumstances arise outside its control.
Short-list
19. Entrants short-listed for the Awards will be contacted using the contact details provided on the application form. The Entrant must ensure that these details are correct and remain correct and that any email account is able to receive emails from RE:Fashion. If RE:Fashion is unable to contact short-listed Entrants within 3 days it reserves its right to withdraw the entry and offer the place at the Awards to another Entrant at its discretion.
20. Short-listed Entrants may be asked by RE:Fashion to provide additional material to support their application and assist the Panel.
Results
21. Winners of the categories at the Awards will be announced on 13th November 2008 at the Awards ceremony.Prizes
22. Any prize(s) must be taken as stated and cannot be deferred. There will be no cash alternatives.
Liability
23. Subject to clause 24, the Entrant agrees that RE:Fashion shall have no liability to it in contract or tort (negligence or otherwise) for any indirect or consequential losses or loss of profit, revenue or anticipated savings.
24. Subject to clause 24, any liability of RE:Fashion to the Entrant in connection with the event shall not exceed GBP 500.00.
25. RE:Fashion does not exclude any liability for death, personal injury or fraud.
Data Protection and Publicity
26. Winners of the Awards, and Entrants commended or short-listed for the Awards, will be requested to make available non-sensitive information on the best practices relating to their application, for example information on the origins, transportation and sustainability of fabrics and other materials used and the location, working conditions and wages of employees.
The best practice information supplied will be used in a best practice database RE:Source. By entering the Awards Entrants undertake to provide such information and consent to it being used in a best practice database. Database entries may be approved by Award Entrants.
27. Winners of the Awards may be requested to take part in promotional activity and RE:Fashion reserves the right to use the names and addresses of winners, their designs and audio and/or visual recordings of them in any publicity. By entering the Awards Entrants consent to their personal data being used for this purpose.
28. Any personal data relating to Entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual‘s prior consent. Data relating to Entrants will be retained by RE:Fashion for a reasonable period after the Awards to assist RE:Fashion to operate future awards in a consistent manner and to deal with any queries on the Awards.
